1. Promoter and scope

1.1 Tomboly is a trading name of AZENTRA GROUP LTD, a private limited company registered in England and Wales under company number 16745724, whose registered office is at 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom (we, us, our or Tomboly).

1.2 These Terms and Conditions (Terms) apply to every prize competition promoted by Tomboly through tomboly.io (Website). Each competition page also contains competition-specific information, including the prize, any cash alternative, entry price, maximum entries, per-person entry limit, opening date, closing date and draw date (Competition Details). The Competition Details form part of these Terms. If there is an inconsistency, the Competition Details take priority only in relation to that competition.

1.3 By creating an account or submitting an entry, you agree to these Terms and the relevant Competition Details. Please read them before entering. Nothing in these Terms affects rights that cannot lawfully be excluded under UK consumer law.

1.4 Tomboly operates prize competitions with a skill question and a free postal entry route. The competitions are intended to be structured in accordance with applicable UK law. No purchase is necessary to use the free postal entry route described in section 6.

2. Eligibility and accounts

2.1 You may enter only if, at the time of entry, you are aged 18 or over, are legally resident in the United Kingdom and are physically located in the United Kingdom. Employees, officers and contractors of Tomboly, and members of their immediate households, may not enter.

2.2 You must create one personal account using accurate, current information. You must not create or use multiple accounts, enter on behalf of another person, sell or transfer an entry, or allow another person to use your account.

2.3 We may use age verification, identity verification, address checks, geolocation controls and other proportionate checks. You must not use a VPN, proxy or other method to disguise your location or identity. We may refuse or void an entry where eligibility cannot be verified.

2.4 You are responsible for keeping your login details secure and for activity conducted through your account. Please contact help@tomboly.io promptly if you believe your account has been compromised.

3. Competition format and information

3.1 Each competition has a fixed allocation of entry numbers and a fixed draw date. Entries close at the earlier of the advertised closing time or the time at which all available entries have been allocated. All times are UK local time unless stated otherwise.

3.2 If entries remain unsold, the draw will still take place on the advertised draw date and the advertised prize will remain available. We will not extend or cancel a competition, or reduce its prize, merely because entry sales are lower than expected.

3.3 Before entering, you should review the Competition Details. Images may be illustrative, but the material characteristics of the prize and any known material limitations will be stated on the competition page.

4. Skill question

4.1 A paid entry is accepted only after the entrant correctly answers the skill question presented for that competition. An incorrect answer does not create an entry and will not be charged.

4.2 The Website may permit an entrant who answers incorrectly to try again or to answer another question. Allowing another attempt does not guarantee entry, and Tomboly is not required to disclose the correct answer.

4.3 A free postal entry must include the answer to the same competition question or to the question identified for postal entrants on the relevant competition page. An incorrect or missing answer makes the postal entry invalid.

5. Paid online entry and payment

5.1 To enter online, log in, select the competition and permitted number of entries, answer the skill question correctly and complete payment. An order is accepted only when payment is authorised and the entries appear in your account or an entry confirmation is issued.

5.2 The total price is shown before payment. We may accept debit cards, credit cards, Apple Pay or Google Pay through our payment service provider, Cashflows, subject to availability and the provider’s terms. Tomboly does not offer a stored-value wallet, virtual coins or a subscription entry product.

5.3 Quantity discounts, entry bundles or promotional codes may be offered transparently. Every entry obtained through a bundle or promotion counts individually towards the competition entry limit and has the same chance of winning as every other valid entry.

5.4 To support responsible participation, credit-card-funded entries are capped at £250 per participant in each calendar month. We may apply lower limits or refuse a transaction where reasonably required for legal, compliance, fraud-prevention or participant-protection purposes.

6. Free postal entry

6.1 You may enter a competition without payment by ordinary first-class or second-class post. The postal route is intended to be no less convenient than the paid route, save for the inherent time needed for postal delivery and processing. You are responsible only for the normal cost of postage.

6.2 You must first hold a verified Tomboly account. The name, email address, date of birth and UK address on the postal entry must match the account details.

6.3 Send each entry in a separate envelope to: Free Entry — Tomboly, AZENTRA GROUP LTD, 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. Entries delivered by hand, courier, recorded delivery or special delivery are not accepted.

6.4 Each envelope must contain a legible, completed and signed Free Postal Entry Form containing: the competition ID or title; your full name; the email address registered to your Tomboly account; your UK residential address; your date of birth; the applicable skill question answer; the acceptance statement shown in Appendix 1; your signature; and the date.

6.5 Only one entry is permitted per envelope. Multiple envelopes are permitted, but every free entry counts towards the same per-person limit as a paid entry. Paid and free entries are included in the same draw on exactly the same basis and have an equal chance of winning.

6.6 Postal entries are processed regularly, normally each business day. An entry must be physically received, verified and capable of being allocated before the competition closes or sells out. Proof of posting is not proof of receipt. We are not responsible for postal delay, loss, illegibility, incomplete information or delivery after entries have closed.

6.7 A valid postal entry will be allocated an available entry number and will appear in the entrant’s account or be confirmed by email. We do not charge an administration fee for a free postal entry.

7. Entry limits and entry numbers

7.1 The maximum number of entries available and the maximum permitted per person are displayed in the Competition Details. These limits apply across all accounts and entry routes combined.

7.2 Entry numbers are allocated automatically from the numbers available for that competition. An entry number has no greater or lesser chance of winning because of when or by which route it was allocated.

7.3 Entries received after a limit has been reached, entries exceeding the per-person limit and entries that are incomplete, inaccurate, unpaid, duplicated, manipulated or otherwise invalid may be rejected or voided.

8. Draw and winner selection

8.1 After entries close, Tomboly will freeze the valid entry list and select the winning entry using a verifiably random and auditable random-number-generation process. The final provider and draw procedure used will be recorded and must be capable of independent verification.

8.2 The draw is intended to be broadcast live on Tomboly’s Facebook and TikTok channels. A recording or draw result will be made available on the Website afterwards. A temporary failure of a third-party livestream does not invalidate an otherwise fair and auditable draw.

8.3 If a technical issue means the integrity of a draw cannot be verified, we may pause the draw and repeat it using the frozen valid entry list as soon as reasonably possible. We will publish an explanation of any material interruption or repeated draw.

9. Prizes and cash alternatives

9.1 Every competition offers the advertised physical prize and a specific cash alternative. The exact cash amount is displayed in the Competition Details. The verified winner may freely choose either the physical prize or the cash alternative; the choice becomes final once confirmed in writing.

9.2 Prizes are not transferable before award and may not be exchanged for a different prize except where these Terms expressly allow. If the physical prize becomes permanently unavailable, the winner will receive the advertised cash alternative.

9.3 For a vehicle prize, the competition page will state whether it is new or used and will disclose the year, recorded mileage, MOT position and any known material defects or condition information. The winner is responsible from handover for insurance, licensing, tax and lawful use.

9.4 Delivery or collection within the United Kingdom is free unless the Competition Details clearly state otherwise. Following successful verification and the winner’s final prize choice, we aim to complete delivery or payment within seven business days. If an unavoidable matter outside our reasonable control causes delay, we will keep the winner informed and complete fulfilment as soon as reasonably possible, normally no later than 30 days.

9.5 A cash alternative will be paid only to a UK bank account held in the verified winner’s name. We will not make payment to a third party.

10. Winner notification, verification and publicity

10.1 We will contact the provisional winner using the account email address and telephone details held by Tomboly. The provisional winner has 21 days from our first notification to respond, claim the prize and provide the information reasonably required for verification.

10.2 Before confirming a winner, we may require proof of identity, age, UK residence, account ownership, payment-method ownership and, for a cash payment, bank-account ownership. A person is not the confirmed winner until these checks are completed.

10.3 If the provisional winner does not claim within 21 days, is ineligible, cannot be verified or has materially breached these Terms, the prize may be forfeited and another winner selected using the same fair draw method from the remaining valid entries.

10.4 For transparency, we may publish the winner’s first name, full surname and county. A winner may request before publication that some or all of this information be withheld or reduced. We may still provide winner information to the Advertising Standards Authority or another competent authority where legally required.

10.5 Any participation in photographs, interviews or promotional content beyond publication of the result is optional and requires the winner’s agreement.

11. Refunds, cancellation and changes

11.1 Once a valid entry has been accepted and allocated, it is final and non-refundable except where required by law, where Tomboly cancels the competition, where a duplicate charge or processing error is attributable to Tomboly, or where these Terms expressly provide otherwise.

11.2 We do not cancel, extend or reduce a competition because of low entry sales. We may cancel, suspend or materially change a competition only where reasonably necessary because of illegality, a binding regulatory requirement, fraud, a critical technical failure, permanent prize unavailability affecting both advertised options, or another exceptional event that makes a fair draw or lawful fulfilment impossible.

11.3 If we cancel a competition, valid paid entries will be refunded to the original payment method and free entrants will be notified where reasonably practicable. We will publish a clear notice. We will not substitute site credit unless the entrant expressly agrees.

11.4 We may correct an obvious typographical or administrative error where the correction does not materially disadvantage entrants. Material changes will be communicated prominently and handled fairly.

12. Fraud, disqualification and account closure

12.1 We may investigate and reject or void entries where we reasonably suspect fraud, payment abuse, chargeback abuse, automated entry, multiple accounts, identity manipulation, location circumvention, collusion, interference with the Website or draw, or another serious breach of these Terms.

12.2 Before taking material action, we will consider available evidence and act proportionately. Where appropriate and lawful, affected payments will be refunded. We may retain information needed to prevent fraud or comply with legal obligations.

12.3 You may close your account at any time by contacting help@tomboly.io. Voluntary closure does not cancel or refund valid entries already accepted; those entries remain in the relevant draw. Entries may be voided where closure follows fraud, ineligibility or a serious breach.

12.4 An unjustified payment reversal or chargeback may result in suspension while the matter is investigated. This does not affect your right to dispute an unauthorised or incorrectly processed payment.

13. Responsible participation

13.1 Prize competitions should be entered for entertainment and within affordable limits. You must not enter using money needed for essential living costs or by borrowing in a way that causes financial harm.

13.2 You may ask us at help@tomboly.io to apply a personal monthly spend limit. A request to reduce a limit will be implemented as soon as reasonably practicable. Any later request to increase or remove a limit may be subject to a cooling-off period and additional checks.

13.3 You may request a temporary participation suspension for at least six months or permanent account closure. During an active suspension, we will block new entries and direct marketing so far as reasonably practicable. Existing valid entries remain eligible unless the law or participant-protection circumstances require another fair outcome.

13.4 We may monitor indicators of excessive or unusual participation and may contact a participant, limit transactions or suspend access where reasonably necessary. If participation is causing concern, independent support is available from organisations such as Citizens Advice, National Debtline, Mind and Samaritans.

14. Privacy and communications

14.1 We process personal data in accordance with our Privacy Policy and applicable data-protection law. The Privacy Policy explains the information we collect, why we use it, retention, sharing and your rights.

14.2 We may send service communications necessary to administer an account, entry, draw, verification, prize or complaint. Marketing communications are sent only where permitted, and you may opt out at any time.

14.3 Our payment service provider processes payment details under its own privacy and security obligations. Tomboly does not require you to send full card details by email or post.

15. Website, availability and intellectual property

15.1 We take reasonable care to keep the Website and competition records available and accurate, but uninterrupted access cannot be guaranteed. Planned maintenance or a short outage does not invalidate entries already recorded.

15.2 If your payment appears successful but no entry is shown, contact help@tomboly.io promptly with the order details. We will investigate the transaction and either confirm the entry, correct the record or issue an appropriate refund.

15.3 The Tomboly name, Website content, designs, software and branding belong to Tomboly or its licensors. You may use the Website only for personal, lawful participation and may not copy, scrape, reverse engineer or exploit it commercially.

16. Liability

16.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory consumer rights, or any liability that cannot lawfully be excluded.

16.2 Subject to section 16.1, Tomboly is responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for unforeseeable loss, business loss suffered by a consumer, or loss caused solely by inaccurate information supplied by the entrant or by an event outside our reasonable control.

16.3 Third-party social-media, banking, payment and telecommunications services are outside our control, but we remain responsible for our own legal obligations and for taking reasonable steps to administer each competition fairly.

17. Complaints and contact

17.1 Questions or complaints should be sent to help@tomboly.io and should include your name, account email, competition, order or entry details and a clear description of the issue.

17.2 We aim to acknowledge or provide an initial response within 24 to 48 hours. We will investigate fairly, keep you informed where more time is needed and provide a substantive outcome as soon as reasonably practicable.

17.3 If you remain dissatisfied, you may ask for the complaint to be reviewed by a senior member of the Tomboly team. This does not restrict any right to contact a consumer-protection, advertising, data-protection or other competent authority.

18. General and governing law

18.1 We may update these Terms for future entries to reflect legal, operational or security changes. The version displayed when an entry is accepted applies to that entry unless a change is required by law or is clearly beneficial to entrants.

18.2 If any provision is found unlawful or unenforceable, it will be adjusted or removed only to the minimum extent necessary; the remaining provisions continue in effect. A delay in enforcing a right is not a waiver.

18.3 These Terms are between you and AZENTRA GROUP LTD. No other person has a right to enforce them, except where legislation provides otherwise.

18.4 These Terms are governed by the laws of England and Wales. As a consumer, you also retain any mandatory protections of the part of the United Kingdom in which you live and may bring proceedings in the courts available to you under applicable consumer law.

19. Platform disclaimer

19.1 Tomboly competitions are not sponsored, endorsed, administered by or associated with Meta, Facebook, Instagram, TikTok, Apple or Google. By entering, you release those platforms from responsibility for the administration of the competition to the extent permitted by law.

19.2 References to third-party names or services identify the channels or technology used and do not imply endorsement.
